I don't know where to start. I am married to a British Citizen and am not going to mail my documents in until a week and a half from now. What is the longest it will take if I hit peak time? They say 5 to 10 business days, but I am still worried. How strict is the UK embassy? MY husband and I don't have savings, but he is employed and we are not seeking public funds. Do I have a chance?

If your husband is already a uk citizen you will have an easier time getting a visa. Provided you meet all the requirements set out in the visa documentation. Public funds means that you are not eligible to apply for support from the government, and you need to be able to work to support yourself. Either that or that your husband is able to provide acommodation and support for you while you are there.

Depends on the Situation
Salman is a British Born Citizen.
Salman recently got married like a 3 month ago, Salman does have a job,he is employed as a security agent, he lives with his parents, his parents provide accommdation for him because he does not have a home for himself since arrival of his wife, Salman and his wife will remain in his parents home and I believe he does not have any savings whatsoever but the thing is Salman he has a job and I sincerely do hope you get a visa.

savings shouldn't matter
I don't think you should be worried about savings as long as your partner is working. The time may vary it all depends but don't worry but pray. We humans worry a lot. All the best.

converting into dependent from a student visa

Hi, i am married with a british citizen, born in the UK. I want to apply the next year for the spouse visa, but i am a little afraid because my husband at the moment receive social benefits due he is on sickness benefits as he suffers from anxiety, so he is not able to work at the moment. He doesn't have too much savings but i am working at the moment in Peru and i do have my own savings. When we will get to the UK, we will live with my father in law, who is retired and is living in a rented house. We lived in the UK for 10 months and now, my husband is with me in my country as i had to come back because my visa expired and he wants to come back to the UK with me, but is just i am scare to the people on the embassy tell me no, because my husband doesn't have a job at the moment. Some advice about this, will be very apreciated.

hello i am in uk on student visa that is going to expire after 4 months and i am going to marry next month with a british citizen. if i extend my student visa so can i convert it to spouse visa later on when we have savings ? will it convert in uk or i need to go back to my home country to change it to spouse visa. and if i need to go to my home country for spouse visa and incase of rejection of spouse visa can i come back on my student visa ?

help!
my husband live in canada, i am a british citizen, im only 20 and he's 21 and this is all so confuzing. i lived in canada for 7 years due to parents jobs and moved back august 2006 thinking we could sort it all out here. we've been living apart for a year now and i've only seen him when i married him last august 2007 for a few weeks. we have a 9 moth old son and i'm pregnant due in may 2008. i'm full time doing gcses in college. and im on benefits until i finish college in june then i hope to find work. the plan is to convince customs that hes going to come here saty with my parents who will support him till one of us find work and get off of benefits. but im terrified they wont see it like that, and even if he gets visa i will lose everything and i cant work and i'm afraid i will lose my college grant and never find decent work as i have no previous qualifications. i'm so stressed i don't know what to do. last time he came here they told him he could only stay 3 days because he was here 5 months before and was on a one way as my parents were going to pay his ticket home so he could stay for birth of our son. customs assumed he might want to illegally work which he didn't at all my mum gave him a 10pound a week allowance. and thats why. i'm afraid this will work against his visa application, even though we've done nothing wrong. i dont want to lose my family just because immigration. i cant go back to canada anymore, my perminant residency has run out. can anyone help?

if you spouse can provide documentation saying they have a jiob waiting for them and its offical even though im on benefits if i say get an affidavit saying i legal state i will renouce my benefits a weekbefore he enters country and my parent will support us if the neeed come till his first pay check, he'll be paid weekly and all other documents for visa and critera are met and we have 2 small babies together. what are our chanse. my husband need to support me will i can work again and my kids need a dad. hes under educated but its a good building job, sercure and he'll earn over 1000-1200 a month

spouses of British subjects having difficulty entering the uk
I see that not many people are aware of the current EU law regarding British subjects exercising a treaty right in another EU country. My husband is Indian, we were married in Italy. He would almost certainly be refused a visa if I returned to the UK and then applied for the spouse visa as he, as a pizza chef, would not be considered a skilled worker. HOWEVER, a British subject who has worked in another EU country for 6 months or more can bring their spouse to the UK without a visa, he or she can work and take up a residency permit in the UK.
To explain better this case: a British subject can go to Italy, get a job as an English teacher with a min 6 month contract (apply to the local council for an identity card, easily given to EU nationals, EU nationals no longer require a permit to stay in Italy). The British subject, under Italian law, can then bring the spouse to Italy as he / she is a member of an EU state and so the Italian embassy will issue a visa to the spouse of an EU state member, it is not required that the spouse can speak Italian and the sponsor only has to earn € 600 a month (about £400)to be eligible to support the spouse. After 6 months the British national applies to the British embassy in Rome for the EEA family permit, which the British embassy under European law cannot refuse. Please see section 21.4.8 on the UK visa's website.

A British national and his/her non-EEA family members can only benefit from free movement rights if they meet the criteria established in the ECJ case of Surinder Singh. The case stated that nationals of a Member State who are exercising an economic Treaty right (i.e as a worker or self-employed person) in another Member State will, on return to their home state, be entitled to bring their non-EEA family members to join them under EC law.
Example: A British national is exercising an economic Treaty right in Germany and living with his non-EEA spouse and children. On the British national's return to the UK, his non-EEA family members can apply for an EEA family permit to join him under EC law.
The Surinder Singh judgement is incorporated into the EEA Regulations in Regulation 9. Family members of British nationals who meet the requirements of Regulation 9 are treated as family members of EEA nationals for the purposes of the EEA Regulations."

Spouse Visa "Settled" Question
I'm wondering if someone might be able to help me with a few questions I have about my settlement visa application.
My spouse is a UK citizen. We have been married for 2 years and we are both living and working in the US.
We need to move to the UK no later than September, when I will start graduate school in London. I don't want to apply for a student visa because I intend to live permanently in the UK.
We have a healthy savings accoung to pay for all our expenses. We don't have a job lined up yet because we can't interview in person because we're in the US.
Does he need to move to the UK, have a lease and find a permanent job before I can get a UK settlement visa? Would our savings account be enough to show that we are not going to claim public funds?
We don't want to separate and I'm hoping there is a way to have a successful visa application

A question or two
Hi, I have a question. I know someone who is being dragged into a situation about getting someone into the country. I want to have my facts correct on this. Guy lives in US, has a criminal record and probably wont even get into UK for a visit let alone to stay. Plan seems to be to get UK girl pregnant when she visits US and then he will get to come over due to being father. I think that is BS and wont be allowed. Am I correct? (I hope so)
I am imagining even if they got married, she would need to do it in US and even then that doesnt guaruntee he gets in does it?

I am married to a romanian and she wants to go to UK to start working so we plan on going together.Please can someone advise me on what to do before my EEA FAMILY PERMIT expires, It says romania have to stay 12months before they can apply for residence. But my visa expires in 6months and she have to have a residence b4 we can both apply for me,it also takes almost 6months to get a reply when you apply at the home office. what can i do?

Hello all, In the case he or she as being given a residence to stay in UK, it will be a little hard to send him back beacuse he or she as not go against the law. I would advise anyone that wants to do that to seak for a lawyer and go to court,Beacuse that a chances or divorce and seperation in the UK and EU law.
If he or she as clean criminal record and currently at that moment employed,i dont think it will be possible to send he or she back ONLY if other things r involve like u where forced or used, and that requires alot of evidence and prove.

I married my husband in pakistan in 2002 and he got a visa straight away and came to uk with me, but after a few months he committed an offence and served a 18 months prision sentance. When he was released i sent off for his application in 2003 but to date have not heard anything back from homeoffice. Now the homeoffice is saying that his passport has expired and he needs to go back to pakistan and get entry clearance but i dont think i want to stay with him anymore as i feel he only with me for visa and is abusive also. once i go back with him to pakistan can i tell the british high commision there that i dont want him her or delay his application? please help

I guess with that surely he wont be given,But most of you people trying to take or send people back home or away.is it really right,why cant u just leave it to God that u where not meant to be together and maybe God just sent u to help him..

You didn"t able to mention clearly either you are still with him or he has already returned to his home country to apply for entry clearance.
Anyway if he is still here you can tell him that i don"t want to be with you and go separate way.
If you are scared from his reaction or living in an abusive environment tnan my advice is to call Domestic violence helpline number or simply the Police.

I am married to a British citizen for about 2 months now. I have applied for a settlement visa to UK but my visa got rejected. My husband is a full time employed. I am not working here in my country. I don't know what to do? I am so upset. Please help me.

Hi Lynda!
Your husband needs to contact British High Commission in Turkey regarding all the information about applying for a spouse visa.
Alternatively you can travel to turkey to join and assist him with relevant documents.
1. You need to provide a documentary evidence that you can accomodate him in Uk.
2. You also need to provide a documentary evidence for available funds and any proof of income, wage slips, bank statements etc etc.
3. You need to satisfy the immigration authorities that you are currently not receiving any public funds and will not do so in futher either.
The second part of your query regarding sponsorship and employment.
If your husband is a highly skilled individual than, this will be a bonus if some employer wants to employ him.
If he is not don"t worry about it, as soon as he will get his spouse visa (Given for Two years normally) he can work straight away after arriving in Uk.
