**Notice to persons in the US who wish to claim refugee status at the Canadian border

What is The Safe Third Country?
For those coming to VIVE, the safe third country in most cases is the United States. A safe third country is a country other than the country the refugee is going to (Canada in most cases) and the country the asylum seeker is fleeing. The Safe Third Country Agreement assumes those seeking refuge can do so in the United States, instead of going to Canada.

Countries exempt from the Safe Third Agreement::

* Afghanistan
* Burundi
* Democratic Republic of Congo
* Haiti
* Iraq
* Liberia
* Maldives
* Rwanda
* Zimbabwe

What do I need to do before arriving at VIVE?
Please call 716-892-4354. If you make an appointment with VIVE we will take you on the scheduled appointment day. Those without appointments may have to wait a day to be registered.

What Time of Day Should I Come to VIVE?
Our staff registers people from 9am-11am Monday-Friday. Please try to arrive during these hours on the day of your appointment. If you arrive after registration hours you will miss your appointment. The office is closed on Saturdays and Sundays.

Can I stay at VIVE La Casa?
Yes, if we have room and either you are on your way to Canada or you have a case in the United States that has been accepted by our legal department. If there is a bed available, you may stay at VIVE for as long as it takes to process your paperwork for immigration.

What is a Refugee?
Immigration law uses the definition from the United Nations of a ‘Convention Refugee.’ Convention refugees have grounds for fearing persecution in their home country because of their:
- race
- religion
- nationality
- membership in a particular social group, or
- political opinion

Can I Make A Refugee Claim?
Yes, but you must be a refugee and then make an application to the U.S. or Canadian Immigration authorities. Because of the Safe Third Agreement that was signed between the US and Canada that are not exempt from this agreement refugees are required to have the following:

In the United States: You must apply within one year of arrival to the United States. Your asylum case must be screened and accepted by the legal department.

In Canada you also have to prove that you have one of the following who is a legal resident of Canada:

* a spouse (or common-law partner)
* a parent (or legal guardian)
* a brother or a sister
* a child (of legal age)
* a grandparent
* an aunt or an uncle
* a nephew or a niece

You must be able to produce a document from these relatives.
A. Copy of birth certificate
B. Copy of legal status.

Documentation needed from refugee applying:
1. Passport and
2. Birth Certificate (original)
or
1. Birth Certificate and
2. Driver’s license from original country or other documentation from original country.

Countries exempt from the Safe Third Agreement::

* Afghanistan
* Burundi
* Democratic Republic of Congo
* Haiti
* Iraq
* Liberia
* Maldives
* Rwanda
* Zimbabwe

You may be disqualified if you have already made a refugee claim in another country or have a criminal conviction.

Can VIVE help me make a Refugee Claim?
This depends on the case. It is important to schedule an in-person appointment to talk to a VIVE staff member. At the time of your appointment with VIVE staff, be sure to bring with you all the documentation and legal papers regarding your refugee claim.

Does VIVE Work for the US Department of Homeland Security (DHS, formerly INS) or Citizenship and Immigration Canada (CIC)?
No. VIVE is an independent, not-for-profit, non-government organization. However, we do work in cooperation with Citizenship and Immigration Canada and the Department of Homeland Security as we assist refugees in making refugee claims.

Is there a fee for services?
VIVE receives donations and grants and does not charge any fees for our services. A $40.00 voluntary donation is requested but not required.

Is there a fee to go to Canada?
Please note that there is no fee required for the Canadian refugee process. If anyone tells you that you must pay a fee to go to Canada, please contact VIVE at 716-892-4354.

How much luggage can I bring?
The number of pieces of luggage/packages you can bring to VIVE and take to Canada is limited to one piece per person.

Where is VIVE Located?
We are located at 50 Wyoming Avenue, in Buffalo, New York, USA. From downtown Buffalo, take Rt. 33 East to the Humboldt Parkway Exit. Turn right at the second light, East Ferry. Take East Ferry for about a mile and turn left on Wyoming (street after Moselle light, after a big church on the left). VIVE is located in the old school 3 doors past the church. MAP

How Do I Travel To VIVE?
By plane arriving at Greater Buffalo International Airport.
Take a taxi to VIVE from the airport, bus, or train station.
By train via AMTRAK (Telephone 1-800-872-7245) (not preferred)
By bus via Greyhound (1-800-231-2222) (not preferred)

Can I Take my Car to Canada?
Yes but first you have to obtain permission from Canadian Customs. Also you would need to have the Title in your name. Their number is (905) 994-6330.
